Drive & Go — Terms and Conditions

For consumers using the Drive & Go app

These Terms are also available in Hungarian (Általános Szerződési Feltételek).

1. The Service Provider

1.1. The Drive & Go app (the "Platform") is operated by the following business ("Drive & Go" or the "Service Provider"):

1.2. Hosting providers: the Platform's server is provided by Render Services, Inc. (525 Brannan Street Ste 300, San Francisco, CA 94107, USA; legal@render.com), its database by Supabase Pte. Ltd. (65 Chulia Street #38-02/03, OCBC Centre, Singapore 049513; legal@supabase.io), and its website by GitHub, Inc. (88 Colin P. Kelly Jr. St., San Francisco, CA 94107, USA; privacy@github.com).

1.3. Users and authorities can contact Drive & Go electronically at support@drivengo.hu; this is the single point of contact, and messages are not handled solely by automated tools. Communication can be in Hungarian or English.

2. Definitions

2.1. User: anyone who uses the Platform. Consumer: a natural person acting outside the scope of their profession, independent occupation or business.

2.2. Partner: a business offering its products on the Platform (café, bakery, shop, etc.); the Partner is the seller of the Product.

2.3. Order: an order placed by the User on the Platform with a Partner. Product: goods offered by the Partner. Service Fee: the fee of Drive & Go under point 6.3. Pickup Point: the place on public or private land near the Partner that the Platform marks for stopping. Pickup Window: the period under point 5.8.

3. How the Platform works and how the contracts are structured

3.1. The Platform is an online marketplace: through it, the User buys Products from Partners. Drive & Go is not the seller of the Products.

3.2. Each Order creates two contracts:

This sharing does not affect the contractual obligations of either the Partner or Drive & Go.

3.4. Partners are businesses. Only a business can be a Partner on the Platform, so the User has consumer rights in respect of the Product.

3.5. Ranking. In the list of Partners, Partners that are open at the moment come first, followed by those that are closed. Within each group, if the User has allowed location access, the Partner's distance decides (nearest first); otherwise the Partner's name (alphabetical order). The featured spot on the home screen shows the first open Partner in the same order. Partners do not pay for their position; there is no paid promotion.

4. User account

4.1. Partners and Products can be browsed without registration; an account is needed to order. Users can register with an e-mail address or — where the app offers it — with an Apple or Google account.

4.2. To order, the User must provide their phone number, the vehicle's licence plate and country code, and their billing details (name and address; for a company invoice, the company name and tax number). The licence plate is used for identification at pickup; the Partner sees the phone number to coordinate about the Order; the billing details are needed for the invoice (6.6.).

4.3. The User is responsible for the accuracy of the data they provide and for making sure nobody else uses their account.

4.4. Only persons aged 18 or over may use the Platform; the User declares this before the first Order (16.1.).

4.5. The User can delete their account at any time in the app, under Profile → Delete account; while an Order is active, deletion can be started once the Order is closed. The Privacy Notice explains which data is kept after deletion and for how long.

5. How an Order works

5.1. Technical steps of concluding the contract:

  1. the User adds Products to the cart; an Order can be placed from a Product value of HUF 1,000;
  2. on the cart summary, the User reviews the Products, their prices, the Service Fee and the total to pay, and can change or delete anything before sending the order;
  3. the User selects the payment method (bank card or — where the app offers it — Apple Pay or Google Pay);
  4. the User sends the Order with the button labelled "Order with obligation to pay";
  5. the Platform confirms receipt of the Order without delay (5.4.);
  6. the Partner accepts or rejects the Order (5.5.).

5.2. Directly before the order button, the Platform displays clearly and prominently the main characteristics of the Products and the total to pay, including all fees.

5.3. These Terms are available in Hungarian and English; the language of the contract is the language in which the User uses the app (Hungarian or English). The contract is not a written contract. Drive & Go records the Order, and the User can view it later in their account, among their orders. Drive & Go has not subscribed to any code of conduct.

5.4. Confirmation. Drive & Go confirms receipt of the Order electronically without delay. It sends confirmation of the concluded contract on a durable medium (by e-mail), at the latest at handover; this confirmation also repeats the request and acknowledgement under point 8.3. If the confirmation of receipt does not arrive within 48 hours, the User is released from their offer.

5.5. Conclusion of the contract. The User's Order is an offer. The contract of sale is concluded when the Partner accepts it. If the Partner rejects the Order or does not accept it within 5 minutes, the Order ends and all amounts are returned under point 7.2. The User can withdraw the Order until the Partner accepts it (7.1.).

5.6. Preparation. The Partner prepares the Products after accepting the Order. The preparation time shown by the Platform is an estimate for information only.

5.7. Pickup instructions. The Platform shows the exact description of the Pickup Point (photo, written steps, stopping zone) after the Partner accepts; it can also be viewed before ordering with a separate button.

5.8. Pickup Window. The Pickup Window lasts at least 120 minutes from the Partner's acceptance, unless the Partner closes earlier: in that case it lasts until closing. If the Order is placed within 120 minutes before the Partner closes, the Platform shows the closing time before payment. No Order can be placed within the time set by the Partner before closing (default: 60 minutes).

5.9. Arrival. The Platform detects the User's arrival using location services; if this does not work, the User can use the "I'm here" button. The button may only be pressed when the User is actually at the Pickup Point; every press is logged.

5.10. Handover. The Partner brings the Products to the User's car and hands them over based on the licence plate provided. The Partner gives a receipt or invoice for the Product at handover.

5.11. Closing. The Order is closed when the Partner records the handover or the User records the pickup — whichever happens first. If neither records it, the Order closes automatically one hour after arrival, or when the User moves significantly away from the Pickup Point — whichever happens first.

6. Prices, fees, payment

6.1. The Partner sets the prices of the Products. All prices are in Hungarian forints (HUF) and include VAT.

6.2. The total to pay = the price of the Products + the Service Fee. Drive & Go charges no other fee.

6.3. The Service Fee depends on the value of the Products:

The Service Fee includes VAT. The HUF 200 charged on a basket below HUF 2,000 is part of the Service Fee, not a separate fee.

6.4. The Service Fee is the consideration for Drive & Go's service; Drive & Go charges no separate fee for using a payment method.

6.5. Payment. Payments are processed by Stripe, a payment service provider. When the Order is placed, the total is either reserved (authorised) or charged on the User's payment method. If the Order ends before handover, we release the reservation or refund the amount charged (7.0.). Drive & Go collects the price of the Products on behalf and in the name of the Partner, as the Partner's commercial agent; this amount belongs to the Partner, and Stripe transfers it to the Partner's Stripe account. The Service Fee belongs to Drive & Go.

6.6. Drive & Go issues an invoice for the Service Fee and makes it available to the User electronically.

7. Cancellation, rejection, refund

7.0. In this point and in point 8, "returned" means: if the total has only been reserved, we do not charge the relevant part (we release the reservation); if it has already been charged, we refund it (7.6.).

7.1. Cancellation until the Partner accepts. Until the Partner accepts the Order, the User can cancel it in the app; in that case all amounts — including the Service Fee — are returned. After the Partner has accepted, the User cannot cancel the Order; this does not affect the right of withdrawal under point 8: for a non-perishable Product, the User may withdraw after acceptance and before pickup as well.

7.2. A full refund, including the Service Fee, is due if (a) the Partner rejects the Order; (b) the Partner does not accept it within 5 minutes; (c) all Products of the Order are out of stock; (d) after accepting, the Partner cannot perform for an exceptional reason (for example, a fire in the kitchen), and customer service records this.

7.3. Partial out-of-stock. If some Products of the Order are out of stock but the Partner hands over the rest, only the price of the missing Products is returned. The Service Fee is not reduced: the fee calculated on the original total of the Order remains, because Drive & Go still provides the pickup-by-car service in full.

7.4. Missed pickup. If the User does not pick up the Order within the Pickup Window, the Partner is entitled to the full price of the Products and Drive & Go to the Service Fee out of the total, and no refund is due; if the total has only been reserved until then, we charge it when the window expires.

7.5. Complaint after handover (missing or faulty Product, quality, "I did not receive it"). The User can submit a complaint or refund request through the channels in point 12.1; customer service examines and records each case individually. If the complaint is justified, at least the price of the Products concerned is returned; if the User did not receive the Order at all, the full total is returned, including the Service Fee. This does not limit the User's statutory warranty rights against the Partner: in case of defective performance, the User may request repair or replacement or, if that is not possible, a price reduction, or may withdraw; the claim can be enforced within two years of performance.

7.6. How refunds are made. Drive & Go refunds the amount due to the same payment method the User paid with; when a reservation is released, nothing is charged. When the money appears depends on the User's bank.

8. Right of withdrawal

8.1. Perishable Products. For Products that are perishable or deteriorate quickly (for example, food, drinks, bakery goods), the User does not have the 14-day right of withdrawal.

8.2. Non-perishable Products. For other Products, the User may withdraw within 14 days of pickup without giving a reason. The withdrawal can be notified (a) using the model form in Annex 2, (b) by any other unambiguous statement, or (c) in the app with the "withdraw from contract" function. We send an acknowledgement of receipt on a durable medium. The Partner refunds the price of the Product, and Drive & Go the Service Fee, within 14 days of learning of the withdrawal; if the User withdraws before pickup, we release the reservation or refund the amount charged (7.0.). The Partner may withhold the price of the Product until the Product is returned or until the User provides clear proof of having sent it back, whichever is earlier. The User sends the Product back to the Partner's address or hands it over at the Partner's shop within 14 days of notifying the withdrawal; the User bears the direct cost of returning it. The withdrawal is addressed to the Partner as seller; Drive & Go receives the statement on the Partner's behalf and forwards it without delay.

8.3. Drive & Go's service. The service under point 3.2 (b) is fully performed at handover. When accepting these Terms before the first Order (16.1.), the User expressly requests Drive & Go to start performance immediately for each Order, and acknowledges that once the service has been fully performed there is no right of withdrawal from it. This does not affect withdrawal under point 8.2 and its effect on the Service Fee.

9. Pickup location and traffic rules

9.1. As the driver of the vehicle, the User is responsible for complying with traffic rules. The Pickup Point is Drive & Go's recommendation: if signs at the location or the traffic situation do not allow stopping, the local rule prevails, and the User should not stop.

9.2. If stopping or waiting at the Pickup Point is subject to a charge, the charge and any surcharge are borne by the registered keeper of the vehicle. Drive & Go does not reimburse them; if the User receives a surcharge at a green Pickup Point during a handover that, according to the app's log, took less than 5 minutes, customer service provides the times of arrival and handover so that the User can contest the surcharge.

9.3. Point 5.9 governs the "I'm here" button; misuse of the button may lead to suspension of the account.

9.4. Age-restricted Products. Alcoholic drinks cannot be ordered on the Platform. If in doubt, the Partner hands over energy drinks only against credible proof of age; without such proof, the Partner refuses the handover and the price of the Product concerned is returned.

10. Food information and allergens

10.1. Food information about the Products — including allergens — is provided by the Partner, who is responsible for its accuracy; the Platform displays the data provided by the Partner before the Order. If in doubt, the User can ask the Partner before ordering.

11. Liability

11.1. Drive & Go is not liable for the Products; the Partner is liable for them as seller (3.3.). Drive & Go is liable for its own service (3.2. (b)), including for the subcontractors it uses.

11.2. Drive & Go strives to keep the Platform running continuously; the service may be temporarily unavailable because of maintenance or a malfunction.

12. Complaints and customer service

12.1. Complaints — including refund requests — can be made by e-mail (support@drivengo.hu; also from the app: Profile → Help & support → Email support) and by post (Tulipán utca 23., 2011 Budakalász, Hungary).

12.2. Drive & Go answers a written complaint in writing and on the merits within 30 days of receipt, and gives reasons if it rejects the complaint. It examines an oral complaint immediately; if this is not possible, or if the User disagrees with how the complaint was handled, it takes minutes. It keeps the complaint and the answer for three years.

12.3. If it rejects a complaint, Drive & Go informs the User in writing which authority or conciliation board they can turn to, with their contact details. Drive & Go has not made a general declaration of submission (to the conciliation boards' decisions).

12.4. Complaints about the Product can also be submitted to Drive & Go: Drive & Go receives them on the Partner's behalf, consults the Partner, and also answers on the Partner's behalf within the deadline in point 12.2. The User can also contact the Partner directly.

13. Remedies

13.1. Conciliation board. In a consumer dispute, the User can turn to the conciliation board (békéltető testület) for their place of residence or stay; at the User's request, the board named in the request acts. The other boards are listed in Annex 3.

13.2. Authority and court. The User can also turn to the consumer protection authority — in general, the government office of the capital or the county (kormányhivatal) — and to the courts. Contact details of the government offices: kormanyhivatalok.hu.

14. Reporting illegal content

14.1. Anyone can report content on the Platform (for example, in a Partner's offer) that they consider illegal: at support@drivengo.hu, stating where exactly the content is and why it is being reported. We give the person concerned a statement of reasons for any restriction of content.

15. Data protection

15.1. The processing of personal data is governed by the Privacy Notice, available in the app (Profile → About & Legal) and on our website, next to these Terms. Accepting these Terms is not consent to any data processing. Use of the app and of Orders does not depend on consent to usage statistics.

16. Acceptance and amendment of the Terms

16.1. These Terms can be read, stored and retrieved in the app before an Order is sent. Before the first Order, on a separate screen, the User (a) accepts these Terms, (b) declares that they are 18 or over (4.4.), (c) expressly accepts points 7.3 and 7.4, which are shown prominently, and (d) requests immediate performance of the service under point 8.3.

16.2. Drive & Go may amend these Terms for the following valid reasons: a change in law or an authority's decision; introducing a new feature or discontinuing an existing one; a change in fees; reasons of security or prevention of misuse. An amendment applies to Orders placed after it takes effect. Drive & Go notifies Users of an amendment in the app and by e-mail at least 15 days before it takes effect; a User who does not accept it can delete their account free of charge at any time, thereby terminating the contract.

17. Final provisions

17.1. These Terms are governed by Hungarian law; this choice of law does not deprive the Consumer of the protection of those provisions of the law of their habitual residence that cannot be derogated from by agreement.

17.2. If any provision of these Terms is invalid, the remaining provisions remain valid.

17.3. Use of the app downloaded from the App Store as software (its licence) is also subject to Apple's standard Licensed Application End User License Agreement, under which the app's provider as shown in the App Store acts as licensor. These Terms govern the Platform's services, Orders and every matter regulated here; if the two differ, these Terms prevail on those matters in the relationship between the User and Drive & Go.

Annex 3 — Conciliation boards

The board for the Consumer's place of residence or stay has jurisdiction; at the Consumer's request, the board named in the request acts. Names are given in Hungarian, as in the law.
